About image permissions:

All the images on the APOD page are credited to the owner or institution where they originated. Some of the images are copyrighted and to use these pictures publicly or commercially one must write to the owners for permission. For the copyrighted images, the copyright owner is identified in the APOD credit line (please see the caption under the image), along with a hyperlink to the owner's location. NASA images are in the public domain, official guidelines for their use can be found here. For images credited to other owners/institutions, please contact them directly for copyright and permissions questions.

Neither NASA nor APOD can grant permission to use copyrighted images. For use of these images, please write to the copyright owners.

Careful. APODs are not necessarily copyright free, or otherwise free to use. Those from NASA projects generally are, but many are the work of private individuals, or nongovernmental entities. You need to see the specific copyright information provided with each APOD to know if and how it can be used.

In case someone else wants to use "Duty Free" images on a business venture (which APODs are), the Blue Giant Acer image cannot copyright by the manufacturer either. Legally anybody can copy, reuse or make knock-offs of their image - they have no legal claim to them.

I don't think there is any violation. NASA images are released without copyright, and can be used commercially or otherwise, with or without attribution. SOHO is a joint venture between NASA and ESA, and ESA is much more proprietary with their data than NASA. However, there's nothing in the so-called SOHO copyright notice (it isn't really a legal copyright notice at all- there seems to be no actual claim of copyright) that prevents commercial use of SOHO images. I doubt very much if SOHO could limit usage of released images (especially in the U.S.) even if they wanted to, and I don't see any evidence that they really care.

What you can't do is use the agency logos, or give any indication that the agencies are endorsing your product. But these laptop and phone skins don't seem to do that.

I can't find it on the APOD website. I'd like to make sure that they are giving credit, paying royalties, etc.
